By accessing and using Oernoe's services, including but not limited to Oernoe Search, Oernoe Studio, and all related platforms (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our Services. Your continued use of the Services constitutes your acceptance of these terms and any updates we may make.

2. License and Access

Oernoe grants you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal, non-commercial purposes. Under this license, you may:

• Access and view content on our Services
• Create an account and maintain your profile
• Use Oernoe Search to perform private web searches
• Use Oernoe Studio to create and manage content
• Store files and data associated with your account
• Access premium features if you maintain an active subscription

This license is personal to you and may not be transferred or assigned to anyone else. You may not reproduce, modify, distribute, or create derivative works of our Services without explicit written permission.

3. Prohibited Conduct

You agree not to engage in any of the following activities:

• Harassment, threats, or abusive behavior toward other users or Oernoe staff
• Posting, uploading, or distributing illegal, defamatory, obscene, or harmful content
• Reverse engineering, decompiling, or attempting to discover source code of our Services
• Scraping, automated crawling, or bulk downloading of content without permission
• Using bots, scripts, or automated tools to artificially inflate metrics or bypass restrictions
• Attempting to gain unauthorized access to our systems or networks
• Interfering with or disrupting the normal operation of our Services
• Spamming, phishing, or attempting to deceive other users
• Violating any applicable local, state, national, or international laws or regulations
• Uploading malware, viruses, or other malicious code

4. User Accounts

When you create an Oernoe account, you agree to:

• Provide accurate, complete, and current information during registration
• Maintain the confidentiality of your password and account credentials
• Accept full responsibility for all activities under your account
• Notify us immediately of any unauthorized access or use of your account
• Comply with all applicable laws and our policies
• Use your account only for lawful purposes

Oernoe reserves the right to suspend or terminate accounts that violate these terms or engage in abusive behavior. Accounts with no activity for 12 months may be subject to deletion.

5. User-Generated Content & Data Ownership

Content you create, upload, or submit through Oernoe Services (including documents in Oernoe Studio, searches, preferences, and files) remains your exclusive property. By uploading content to our Services, you grant Oernoe a worldwide, non-exclusive, royalty-free license to:

• Store and maintain your content for service delivery
• Display your content within the Services according to your privacy settings
• Backup and replicate your content for data protection and disaster recovery
• Analyze aggregate, anonymized data to improve our Services

Oernoe does not claim ownership of your content. You retain all intellectual property rights. You are solely responsible for ensuring your content does not infringe on third-party rights or violate any laws.

Upon account deletion, we will remove your content from our active systems within 30 days, though backups may be retained temporarily for security purposes.

6. Search Results and Content Responsibility

Oernoe Search aggregates content from across the web. We do not create, edit, or endorse search results. Oernoe is not responsible for:

• The accuracy, legality, or appropriateness of search results
• The content of third-party websites linked in search results
• Any damages or losses resulting from reliance on search results
• Broken links or outdated information in search results

Oernoe reserves the right to remove illegal content or content violating these terms. If you find inappropriate content in our search results, please report it to legal@oernoe.com.

7. Beta & Experimental Services

Some Oernoe Services may be labeled "beta," "experimental," or "preview." These services:

• Are provided "AS-IS" without warranties or support guarantees
• May change, be modified, or discontinued without notice
• May have reduced privacy protections or different data handling practices
• Are not recommended for production use or critical work
• May have data loss or service interruption risks

We will clearly label beta services and explain any special terms. Use of beta services is at your own risk.

8. Premium Features & Payments

Core Oernoe Services are free. Some premium features may be available for a fee. By purchasing premium features, you agree to:

• Pay the stated price and any applicable taxes
• Provide accurate billing and payment information
• Allow us to charge your payment method automatically for recurring subscriptions
• Review billing statements and report errors promptly

Refunds: Refunds are handled on a case-by-case basis. Contact billing@oernoe.com to request a refund within 30 days of purchase. Premium subscription cancellations take effect at the end of the current billing period.

9. Intellectual Property Rights

All content on Oernoe Services, including text, graphics, logos, images, software, and data compilations, is the exclusive property of Oernoe or its licensors and is protected by international copyright laws. This includes:

• Oernoe's search algorithm and indexing technology
• Oernoe Studio's interface and creation tools
• Our website design, layout, and interactive features
• Our trademarks, logos, and brand identity

You may not reproduce, modify, distribute, or create derivative works without explicit written permission.

10. Disclaimer of Warranties

Oernoe Services are provided "AS-IS" and "AS AVAILABLE" without warranties of any kind, express or implied. Oernoe specifically disclaims:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, completeness, or up-to-date information
• Warranties of uninterrupted or error-free service
• Warranties of security or protection against unauthorized access

Use of our Services is at your sole risk. We make no guarantees about uptime, performance, or specific outcomes.

11. Limitation of Liability

To the maximum extent permitted by law, Oernoe and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, revenue, profits, or business opportunities
• Business interruption or service unavailability
• Unauthorized access to or alteration of your content
• Third-party claims or legal costs

Even if Oernoe has been advised of the possibility of such damages. In jurisdictions that do not allow limitation of liability, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Oernoe, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your violation of these Terms; (b) your use or misuse of the Services; (c) your content or user-generated materials; (d) your violation of any third-party rights; or (e) your violation of any applicable laws.

13. Service Modifications & Downtime

Oernoe may modify, suspend, or discontinue Services (or any part thereof) at any time, for any reason, with or without notice. We may perform maintenance or updates that temporarily interrupt service. We will attempt to provide advance notice when possible, but do not guarantee uninterrupted service access.

14. Termination of Access

Oernoe may terminate or suspend your account and access to Services immediately, with or without cause or notice, if we reasonably believe you have:

• Violated these Terms of Service or other Oernoe policies
• Engaged in illegal or harmful conduct
• Abused our Services or another user
• Posed a security or legal risk to Oernoe or other users

Upon termination, your right to use the Services ceases immediately. You must delete any offline copies of content you've downloaded.

15. Third-Party Links & Integrations

Our Services may contain links to third-party websites, services, and platforms. Oernoe is not responsible for:

• The accuracy, legality, or appropriateness of third-party content
• Third-party privacy practices or terms of service
• Any damages or losses from third-party services
